Spell x Business & Pleasure Competition Terms & Conditions

The SPELL X BUSINESS & PLEASURE CO Competition (“Spell x Business & Pleasure Co. Promotion”) is conducted by Spell Designs Pty Ltd (ABN 68 605 908 496) of Unit 1/14A Banksia Drive, Byron Bay, NSW, Australia, 2481 (“Spell”) in collaboration with, Business & Pleasure Co Pty Ltd (ABN 28 621 392 649) of Unit 10/570 Gold Coast Highway, Tugun, QLD, Australia, 4224 (“Business & Pleasure Co.”) (“the Promoters”).

The instructions below, on how to enter the Spell and Business & Pleasure Co. Promotion, form part of the terms and conditions of entry. By entering the Spell and Business & Pleasure Co. Promotion, all entrants will be deemed to have accepted and agreed to be bound by these terms and conditions (as “Conditions of Entry”).  

1.   The Spell and Business & Pleasure Co. Promotion opens at 6.00PM on Thursday, 10 November 2022 (AEDST)(“Start Date”) and closes at 6.00PM on Monday, 14 November 2022 (AEDST)(“End Date”).  
2. Entry to the Spell and Business & Pleasure Co. Promotion is open to Australian residents only. Entrants must be 18 years or over, at the time of entry, to enter and claim the Spell and Business & Pleasure Promotion Prize Pack below.
3. Employees of the Promoters and agencies associated with this Promotion (Spell and Business & Pleasure Co.) are ineligible to enter the competition, as are their immediate families.
4. To enter, entrants must before the End Date:
   • Complete the online entry located on the Spell or Business & Pleasure Co websites at spell.co/au/SpellxBusiness&PleasureCoPromotion or at www.businessandpleasureco.com.au/SpellxBusiness&PleasureCoPromotion; and
   • Subscribe, or be a subscriber, to both the Spell and Business & Pleasure Co. email marketing databases via the online entry form or at https://aus.spell.co or at businessandpleasureco.com.au.
5. By entering the Spell and Business & Pleasure Co. Promotion, entrants agree and acknowledge that they are subscribing to the email marketing database of both Spell and Business & Pleasure Co. which will record their email address, first name, last name, and postcode. Entrants who choose to ‘opt-in’ consent to have their contact details (email, first name, last name, email) collected by the Promoters, consent to receiving marketing from Spell and Business and Pleasure. Co. Subscribers may ‘opt-out’ of our databases at any time.
6. One (1) lucky winner of the Spell and Business & Pleasure Co. Promotion will drawn at random by chance on 21 November 2022. Business & Pleasure Co. will email the lucky winner via the email address provided by the entrant, at our earliest possible convenience and by no later than 6.00PM on 22 November 2022 (AEDST).
7. Every effort will be made to contact the winners within 28 days of the End Date, at which time Spell and Business & Pleasure Co. at their discretion will proceed to a second chance draw and award the prize to another valid entrant. A second chance draw will take place on 21 December 2022 if the first winner cannot be contacted by email within 28 days of the Spell and Business & Pleasure Co. Promotion end date above.
8. The winner of the Spell and Business & Pleasure Co. Promotion will win the following Prize Pack to one (1) lucky winner with the total prizes valued at up to $2995.00AUD including:

1) Spell Gift Card (valued at up to $1000)

2) Beach goods from Business & Pleasure Co. (valued at up to $1000)

3) 2 x Night Stay at Raes on Wategos (valued at up to $995).

9. All travel costs and other ancillary expenses incurred are not included in this Prize Pack including spending money, flights, meals, insurance, taxes, passports, visas, extra accommodation, vaccinations, airport transfers, additions to stipulated itineraries and offered flights and all other ancillary costs are the responsibility of the winner. Unless expressly stated, all other expenses become the responsibility of the winner.
10. The prize is not transferable, not redeemable and not exchangeable for cash. Any attempt to resell or auction all or any part of this prize will result in an immediate cancellation of the prize. Prize cannot be exchanged for another itinerary. If the winner is unable to travel due to personal reasons or any other circumstances, the Prize Pack will be forfeited. The winner of the accommodation prize is required to obtain suitable travel insurance at their own expense to be able to take the prize. Dates of the 2 night stay at Rae’s will be decided by Business & Pleasure Co. 2023 between 1 February 2023 and 31 October 2023.
11. All decisions of Spell and Business & Pleasure Co. in relation to the Spell and Business & Pleasure Co Promotion are final and binding. No correspondence, discussion or disputes will be entered in with any entrant including the winner.
12. You can enter as many times as you like, provided you comply with these rules each time and one (1) email equals, one (1) entry. Incomplete, indecipherable entries or entries that do not comply with these rules will be deemed invalid. The Promoter reserves the right to verify the validity of entries.
13. In the event that for any reason whatsoever, the winner cannot or does not take any part of the Prize Pack, then that part of the Prize Pack will be forfeited by the winner, and cash will not be awarded in lieu of that part of the prize.
14. All entries become and remain the property of Spell and Business & Pleasure Co. and our agencies and affiliates associated with this Spell and Business & Pleasure Co Promotion. Spell and Business & Pleasure Co will adhere to and comply with all privacy laws, SPAM laws and other State and Federal laws and regulations.
15. Where the information entrants are asked to provide to Spell and Business & Pleasure Co. is personal information it is protected by the Privacy Act 1988 (Cth) and all other State and Federal privacy laws. Spell and Business & Pleasure Co and their other agencies will not disclose this information to other parties other than in accordance with the Privacy Act 1988(Cth) andSPAM Act 2013(Cth), and all other State and Federal laws.
16. Personal information provided by an entrant to Spell and Business & Pleasure Co. for the purpose of entering this Promotion will be collected, used and disclosed for marketing purposes in accordance with Spell’s Privacy Policy and Business & Pleasure Co’s Privacy Policy.
17. Personal Information collected will be kept strictly confidential and will not be sold, reused, rented, loaned or otherwise disclosed to any third party otherwise than in accordance with the Business & Pleasure Co. Privacy Policy and Spell’s Privacy Policy and these terms and conditions. The Promoter may use the entrant's names and literary pieces for commercial purpose, including future promotional marketing and publicity purposes.
18. Spell and Business & Pleasure Co. reserve the right to withdraw or amend the Spell and Business & Pleasure Co Promotion and amend these terms and conditions as necessary at any time, due to circumstances outside their control. The Promoters reserves the right to substitute any component of the prize for an itinerary of equal value at their discretion.
19. The Promoters shall not be liable for any loss or damage whatsoever suffered (including, but not limited to indirect or consequential loss) or for personal injury, which is suffered or sustained, in connection with the Spell and Business & Pleasure Co. Promotion or Prize Pack, except for any liability or statutory consumer guarantees, which cannot be excluded by law.
20. The prize is subject to availability as determined by Raes on Wategos. The prize is valid for 12 months from 1 February 2023 until 30 November 2023. Booking block-out periods may apply for December 2022 and January 2023 including the Easter period in 2023.
21. Upon acceptance of the prize, the winner acknowledges that they have read and agreed to Rae’s on Wategos booking terms and conditions as outlined in the Raes on Wategos Terms & Conditions available via the Raes on Wategos website at https://raes.com.au/booking-terms-conditions/.
